Applewood Credit Date: January, 8 2020

Employee: Justin Plosz

Other People involved:

Brent Sayles - Vice president of sales @ Applewood Motors Auto Group

Alexander Peterson - General Manager @ Applewood Motors

Darren Graham- Owner @ Applewood Motors

I successfully negotiated and signed a contract with Alexander Peterson who is the current General manager at Applewood Motors who represents himself with the power to do so. His desk sits right next door to the owners office of the whole Applewood Motors franchise which made it look very believable. Negotiations started in a meeting that took place on Monday, August.12 2019, after 6 more separate meetings of negotiating the terms and conditions. We had reached and signed a deal on September 4,2019, and the contract was drawn up and signed in the Alex’s office at the Original Applewood Motors store.

I was paid for my services in September and October but when November came the money stopped being automatically deposited into my account. I called into the dealership and asked for the CFO but was told he couldn’t talk to me about it and to talk to Alexander Peterson. After Alex was unable to fix the problem, This was only fully brought to my attention on Monday, January,6 2020 in a face to face meeting with him at the Original Applewood Motors location. At that time I contacted Glen from the red customer satisfaction phone in the showroom and was redirected to Brent Sayles who is the president of Sales and operations.

I was issued 4 direct deposits into my account for my services with the following dates and amounts:

$2000.00 September Advance Direct Deposited on Monday, September, 30 2019

$6289.78 September Pay Direct Deposited on Tuesday, October. 15 2019

$2000.00 October Advance Direct Deposited on Thursday, October, 31 2019

$6525.22 October Pay Direct Deposited Friday, November, 15 2019

Once the first direct deposit was missed, I contacted Alex and was told that he would fix it and that he would send me the money from his own account. He told me he would fix the error and everything would be fine. As time went on I kept asking if it had been fix and he said the CFO was working on it and that he would send me more money till they could resolve the issue. The amounts and dates are provided below.

Note: I have over 18 minutes of phone recorded conversations between myself and Alex to prove the facts above and bank statements to prove the facts above and below.

Offer to close account denied (Statement of account attached)

I had made and offer to close the account and renegotiate the contract in hopes to keep my team at the store was send via text message to directly to Brent Sayles cell phone on the morning of Wednesday, January 8. 2020 @ that expired at the end of the business day.

Applewood Credit Defence (Brent Sayles)

Brent Sayles called me back later that day on January 8, 2020, and said because his signature was not on the document and he knew nothing about it that Applewood credit was not going to honour the contact any longer. He also went on to say that Alex did not have signing authority for the dealership so the contract in null and void.

Applewood Credit & Alex Perterson offer to Justin Plosz settle

At around 6:00 pm on the night of January, 9 2020, Justin Plosz was told to come down to the dealership by Alexander Peterson to receive payment for his services. Without having money for rent, Justin Plosz was put into a situation where he felt he had to go. Once he got the he was presented with an offer of $5000.00 and asked to sign another contract called “Full, Final and Absolute Release” to get the money. Justing noticed that on page 2 of the contract that Alexander Peterson was presenting that he was once again the person signing off at the bottom of another legal binding document in relations with Applewood credit and himself for a second time. After stating that he had no signing authority for Applewood credit on the first contract. This didn’t seem right to Justin Plosz so he took the document and contacted a lawyer so look farther into it.

Note: Justin has a 8 + min video conversation record of this negotiation

What Justin Plosz is looking to be compensated for:

  • Lost income

  • Late fees

  • Interest

  • NFS’s

  • Traveling expenses

  • Lost opportunity

  • Stress and anguish

  • Destruction of future earning (10 Years)

Notable Information:

The magnitude this contract holds, had me exclusively working with Applewood motors making this my only source of income and has used up the resources I have acquired over the last 13 years in the Auto Industry. I am looking for a payout for the sum I have lost plus the amount of money I will have lost in the future to the amount of 10 years. This has lead me to lose the stability for my team the I have been working towards for the last 13 years. i could never rebuild what i had in 10 years no matter how much money i was given.

$33,793.55 - Unpaid

I have endured the cost of interest, late fees, NFS’s, traveling expenses and lost opportunity.

People on my team I hired and brought to the store:

Justin Steener - Team Lead Finance director and company contract involved int the agreement regarding XXXXXXX BC LTD

Rishi Verma - Moved from Edmonton - provided a home for him to live for free for 3 months so he could work there

Ashley Taylor - Scouted from another Team

Altaf Ebrahim - Scouted

Roman Janicek - Brought over from Edmonton - Lived with me fro 3 months so he could work here

Trevor Van Os - Brought over from old contract

Matt Two - Brought over from old contract

The team produces an average net profit between $100,000.00 to $200,000.00 per month for the store.

Both Alexander Perterson and Brent Sayles have said that the dealership refuses to pay me the full amount I am owed and have not asked to renegotiate the contract and have told me they plan on keeping the employees I have hired to work at the dealership.

Thank you, Justin Plosz

I put this out there to help people not make the same mistake i did.
